General Terms and Conditions Qurios Holiday Retreats
If you make a reservation with Qurios Holiday Retreats via the Internet or telephone, these terms and conditions apply.
When making reservations in any other way, only these supplementary terms and conditions apply.
1.1 These General Terms and Conditions apply to all offers, reservations and agreements regarding all accommodations and other facilities that are let out by Qurios Holiday Retreats or affiliated companies.
1.2 In these General Terms and Conditions, the term ‘Lessee’ will mean: the person concluding an agreement with Qurios Holiday Retreats regarding the lease/use of accommodation. The term ‘User’ ( also referred to as Guest) will mean: the Lessee and the persons specified by the Lessee in advance that (will) make use of the accommodation and/or other facilities leased by the Lessee.
1.3 These General Terms and Conditions apply regardless of your (prior) reference to any terms and conditions of your own or other general terms and conditions. Qurios Holiday Retreats rejects all General Terms and Conditions to which you refer or which you use.
1.4 Arrangements deviating from these General Terms and Conditions are valid only if agreed in writing.
2.1 Qurios Holiday Retreats only takes up reservations from persons that are at least 18 years old. Reservations made by persons younger than this age are therefore legally invalid.
2.2 Qurios Holiday Retreats reserves the right to - without stating any reasons - refuse non-standard reservations, particularly from youths or groups, or to special conditions to such reservations.
2.3 If Qurios Holiday Retreats takes up your reservation, Qurios Holiday Retreats will send you a booking confirmation and an invoice within 14 days after making the reservation. Please check these for errors immediately after receipt. Any errors must be announced immediately to Qurios Holiday Retreats.
2.4 If you have not received a booking confirmation / invoice within 14 days after making the reservation, please contact the reservations department forthwith. Failing this, the reservation cannot be relied on.
2.5 You automatically enter into an agreement with Qurios Holiday Retreats the moment Qurios Holiday Retreats confirms the reservation to you.
2.6 The agreement concerns the lease of accommodations and/or other facilities for recreational use, which is of a short duration by nature.
3. CHANGES TO THE AGREEMENT
3.1 If you wish to make changes to the agreement after its formation, Qurios Holiday Retreats is not obliged to accept these changes. Qurios Holiday Retreats may decide, at its own discretion, if and to what extent it will accept these changes. In the event that Qurios Holiday Retreats accepts your changes, Qurios Holiday Retreats will charge you change fees.
3.2 As from 28 days before arrival, changes to the arrival date and/or location are no longer allowed.
In such events, the cancellation fees described in article 14 of these General Terms and Conditions apply.
3.3 If you wish to reduce the number of accommodations after the formation of an agreement for more than one accommodation, the cancellation conditions described in article 14 of our General Terms and Conditions apply.
4.1 Unless otherwise agreed with Qurios Holiday Retreats, the Lessee and other Users may not - under any description and for whatever reason - cede the use of the accommodation to persons other than those stated in the agreement.
4.2 If you and Qurios Holiday Retreats agreed that you and/or one or more Users will be replaced, you, in addition to the Lessee and/or Users that replace you and/or other Users, will remain jointly and severally liable towards Qurios Holiday Retreats for the payment of any rent due, change fees (see art. 3.1) and addi.onal costs resul.ng from the substitution plus any cancellation fees.
5.1 You owe Qurios Holiday Retreats the agreed rent as stated in the booking confirmation and the invoice for the reservation.
5.2 Price discounts and/or special offers can no longer be used once Qurios Holiday Retreats has sent the booking confirmation / invoice.
5.3 Unless stated otherwise, all prices are inclusive of VAT where applicable.
5.4 Qurios Holiday Retreats is entitled to implement and offset price increases as a result of interim adjustments to statutory regula.ons and/or provisions (including but not limited to VAT, tourist tax, insurance premium tax) on which Qurios Holiday Retreats has no influence.
6. ADDITIONAL COSTS
6.1 In addition to the rent, you / the Lessee also owe reservation and handling fees, bed linen and park charges.
6.2 The park charges contribution is determined partly, but not exclusively, by the tourist tax established by the municipality governing the park's place of business. You / the Lessee always owe Qurios Holiday Retreats the park charges stated on the booking confirmation.
7.1 On reservation, you must make a down payment of 30% plus reserva.on and handling fees and insurance premiums. Payment of the aforementioned amounts must occur within 14 days after the date of the booking confirmation / invoice of the reservation with Qurios Holiday Retreats.
7.2 Qurios Holiday Retreats must receive the remaining rent no later than 8 weeks before the date on which the stay at Qurios Holiday Retreats starts, as stated in the booking confirmation / invoice.
7.3 If a reservation is made between 8 and 4 weeks before the start of your stay, then, in derogation of the above, the full amount (rent plus the costs referred to in 7.1 and 7.2) must be paid within 7 days after the date of the booking confirmation / invoice. If a reservation is made within 4 weeks before the start of your stay, the full amount (rent plus the costs referred to in 7.1 and 7.2) must be paid immediately. If on arrival at the park it becomes apparent that the amount has not yet been added (in full) to the bank account of Qurios Holiday Retreats, you must pay the (remaining) amount on the spot. If you fail to pay in conformity with the above, Qurios Holiday Retreats may deny you the use of
the accommodations and/or other facilities. Should it become apparent later that the amount had not yet been added to the back account of Qurios Holiday Retreats although you had in fact issued a payment order, the overpaid amount will be refunded afterwards.
7.4 In the event that payment of the amounts invoiced to you is late, you will enter default immediately after the payment term expires. In this case, Qurios Holiday Retreats will give you the opportunity to pay the owed amount as yet within 7 days. If payment is not forthcoming even then, Qurios Holiday Retreats reserves the right to terminate (cancel) the agreement with effect from the day on which the 7 day period expired and you will be liable for all damage that Qurios Holiday Retreats suffered or will suffer as a result, including all costs that Qurios Holiday
Retreats had to incur in connection with your reservation and the termination. Qurios Holiday Retreats is in any event entitled to charge cancellation fees per accommodation. In that case, the provisions of article 14 apply.
7.5 Qurios Holiday Retreats is at all times entitled to set off any claims on you, of whatever nature, against the amounts paid by you, for whatever reason.
8. ARRIVAL AND DEPARTURE
8.1 The leased accommodation can be occupied as from 15:00 on the agreed date of arrival as stated on the booking confirmation. The accommodation must be vacated before 10:00 on the agreed date of departure as stated on the booking confirmation.
8.2 If you wish to continue the agreement with Qurios Holiday Retreats beyond the agreed duration and Qurios Holiday Retreats agrees to this, Qurios Holiday Retreats is at all times entitled to assign a different accommodation.
3 If the use of the accommodation and/or other facility is terminated before the agreed date as stated on the booking confirmation, the Lessee is not entitled to a refund of (a por.on of) the rent and/or costs by Qurios Holiday Retreats. If you took out a cancellation insurance and you meet the requirements set by the insurance company, you may file a claim in respect of the early termination of your stay directly to the insurance company.
9.1 All Guests must abide by the rules established by Qurios Holiday Retreats for the parks, laid down in among other things the Park Rules. You can request a copy of these Rules at the reception upon arrival.
9.2 In conformity with the local by-laws, you must provide proof of your identity on ‘check-in’, if requested. If the Guests cannot provide proof of their identity, Qurios Holiday Retreats may decide not to house the Guests.
9.3 Each accommodation may only be inhabited by the maximum number of persons listed for the accommodation in question in the brochure or on our website.
9.4 Qurios Holiday Retreats reserves the right to change the design and the opening hours of the
parks’ facilities. For the purpose of required maintenance, you will allow work to be performed on the accommodation or other facilities during your stay without the right to a compensation.
9.5 For safety reasons it is not allowed to place tents near the accommodation.
9.6 The Lessee must deliver the accommodation broom clean (i.e.: no dirty dishes, bedding removed
and folded, kitchen and refrigerator clean, garbage in the appropriate container).
9.7 The Lessee and Users are obliged to rent bed linen with the accommodation from Qurios Holiday Retreats.
9.8 If you fail to follow the rules included in these General Terms and Conditions, the rules of the Park Rules or the instructions of staff, Qurios Holiday Retreats is entitled to remove you, the Lessee and any other User from the park immediately and without a refund of the rent or parts thereof.
9.9 If the park management has a strong suspicion that the Lessee of an accommodation acts contrary to the law and/or public policy and/or good morals, the park management is authorised to gain access to the accommodation.
10.1 Depending on the accommodation, Qurios Holiday Retreats allows at most one dog of the Lessee or Users. If you and/or other Users wish to bring a dog, you must state this directly upon reservation. In that case, you will pay a surcharge which will be charged by Qurios Holiday Retreats. No other pets are permitted. Qurios Holiday Retreats reserves the right to refuse pets from the park without stating any reasons.
10.2 Dogs are not permitted in the water features, restaurants, central indoor facilities and other public places within the park (unless stated otherwise on site). Dogs must be kept on a leash outside of the accommodation. On-site instructions must be followed. The dogs must not cause any inconvenience to the other guests.
10.3 A dog basket and protection against fleas are required. Anti-flea drops, pills or collar will suffice.
10.4 Visitors’ dogs and pets are not permitted.
10.5 In order to transport animals within countries of the EU, you must be in the possession of a pet
passport according to European model (as from 3 July 2004).
The animals must be vaccinated against rabies and must be identifiable by chip or tattoo. You are responsible for possessing the correct travel documents required for your destination.
11. USE OF ACCOMMODATION; INVENTORY
11.1 The Lessee / User and those that accompany the Lessee are jointly and severally responsible for an orderly course of affairs in and around the leased accommodation or elsewhere in the park, use of the accommodation and the equipment present therein.
11.2 In addition, the Lessee / User and those that accompany the Lessee are at all .mes jointly and severally liable for damage by breakage and/or loss and/or damage to inventory and/or accommodation. The Lessee must immediately report and compensate any damage to Qurios Holiday Retreats on the spot, unless the Lessee can prove that neither they, other Users nor one of the members of their company can be blamed for the cause of the damage.
12. INTERNET USAGE
12.1 Depending on the accommodation, Qurios Holiday Retreats offers the Lessee / User and those that accompany the Lessee access to the Internet through a Wi-Fi network or through cable.
12.2 The Lessee is responsible for the correct use of the Internet and the hardware and software, configuration, peripherals and connections required in support thereof and measures to protect the security of computers or opera.ng systems.
12.3 Qurios Holiday Retreats is not liable for damage resulting from Internet usage or network failure.
12.4 While using the Internet, the Lessee / User and those that accompany the Lessee must behave as may be expected from a responsible and careful Internet user and respect the rules of law. The Lessee / User will refrain from conduct that causes inconvenience to other Internet users or damage to Qurios Holiday Retreats in the broadest sense of the word. The Lessee / User and those that accompany the Lessee will refrain from visi.ng Internet websites that are of an unlawful nature or that are incompatible with the reputation of Qurios Holiday Retreats as a provider of accommodation.
12.5 If inconvenience to third parties and/or (other) Internet abuse by the Lessee / User and those that accompany the Lessee is observed or suspected, Qurios Holiday Retreats is entitled to partially or fully block Internet access without further notice.
12.6 The Lessee indemnifies Qurios Holiday Retreats against third-party claims for compensation of damage that these third parties might in any way (atempt to) recover from Qurios Holiday Retreats, to the extent that these claims are based on the Internet usage by the Lessee / User and those that accompany the Lessee.
13. SECURITY DEPOSIT
13.1 Qurios Holiday Retreats may require you to leave a security deposit at the start of your stay. The security deposit amounts to €500 per accommodation but may be increased by Qurios Holiday Retreats if the circumstances give reason to do so (such as with groups).
13.2 The security deposit serves as a security for damage and/or costs - in the broadest sense of the word - that Qurios Holiday Retreats might incur if the Lessee / User and those that accompany the Lessee fail to perform their obligations.
13.3 In the event that the security deposit is not paid immediately, Qurios Holiday Retreats is entitled to deny the Lessee and/or other Users access to and use of the accommodation.
13.4 If you remain in default of payment regarding the security deposit, Qurios Holiday Retreats is furthermore entitled to terminate (cancel) the agreement with immediate effect.
13.5 The security deposit or any remainder thereof will be refunded after seeking off any claims of Qurios Holiday Retreats (damage to inventory / accommodation and/or other costs) on the Lessee and/or Users. Any (further) claims on damages are cancelled out by this refund.
14. CANCELLATION FEES
14.1 If a reservation is cancelled, cancellation fees fall due. These fees amount to:
- 30% of the total amount up to 28 days before the date of arrival
- the full total amount as from the 28th day before arrival and beyond
Cancellations must always be communicated to Qurios Holiday Retreats in writing.
14.2 You can insure yourself against cancellation risks by taking out a cancellation insurance when making your reserva.on.
14.3 If you have not arrived within 24 hours after the agreed date and have given no further notice, this will be considered a cancellation.
15. ADVANCE RESERVATIONS
15.1 It is possible to make reservations for a period for which no rates have yet been published. The Lessee must pay €30 as a down payment, which will be set off against the definitive amount. If the temporary reservation is not converted into a definitive reservation, the down payment will be refunded.
16. FORCE MAJEURE AND PROPOSED ALTERATION
16.1 In the event that Qurios Holiday Retreats is unable to execute the agreement - be it fully or partially, temporarily or not - due to force majeure, Qurios Holiday Retreats may propose an alteration (different accommodation / different period etc.) within 14 days after it became aware of the impossibility to execute the agreement.
16.2 There is force majeure on the part of Qurios Holiday Retreats if the execution of the agreement is fully or partially, be it temporarily or not, prevented by circumstances beyond the control of Qurios Holiday Retreats, including threat of war, strikes, blockades, fires, floods and other disturbances or events.
16.3 You are entitled to reject the proposed alteration. If you reject the proposed alteration, you must give notice of this within 14 days after receiving the proposed alteration. In that case, Qurios Holiday Retreats is entitled to terminate the agreement with immediate effect. You are then entitled to remission and/or a refund of the (already paid share of the) rent. Qurios Holiday Retreats will in that case not be obliged to compensate any damage.
17.1 If on reservation the personal details of you and/or other Users are not fully and/or incorrectly stated, Qurios Holiday Retreats is at all times entitled to terminate the agreement with immediate effect. In such an event, there will be no refund of the rent or parts thereof.
18.1 Qurios Holiday Retreats accepts no liability for theN (including theN from safe-deposit boxes or lockers), loss of or damage to property or persons, of whatever nature, during or as a result of a stay at one of our parks and/or the lease / use of accommodations and/or other facilities of Qurios Holiday Retreats, unless these are the result of the intent or gross negligence of Qurios Holiday Retreats or (one of) its employees.
18.2 Qurios Holiday Retreats is not liable for breakdowns in the provision of services or defects in the services provided by third parties.
18.3 You and the User are jointly and severally liable for all loss and/or damage to the leased accommodation and/or other property of Qurios Holiday Retreats that arises during the use thereof by you and/or other Users, regardless of whether it is the result of your actions or omissions and/or those of third par.es that are in the park with your permission.
18.4 You indemnify Qurios Holiday Retreats against all third-party claims regarding damage that is the result of any actions or omissions by yourself, other Users, your travelling companions or third parties that are in the park with your permission.
18.5 Additional costs will be charged in the event that the accommodation is used and/or leN incorrectly, including but not limited to excessive pollution, which costs you must then pay immediately.
19.1 You may believe that you have a justified complaint regarding your holiday stay despite the care and effort of Qurios Holiday Retreats. You must initially report this complaint on the spot and directly to the management of the park at which you stay. Should the complaint not be handled to your satisfaction, you have the opportunity - for at most 1 month after departure from the park at which you stay - of filing the complaint in writing to: Qurios Holiday Retreats B.V., Olympisch Stadion 24-28, 1076 DE Amsterdam or via info@Qurios.nl stating your reservation number, name and address, date of stay, name of park and accommodation number. The complaint will then be handled with the greatest care.
Should this not lead to a satisfactory solution either, you have the opportunity - for at most 3 months after departure from the park - to have the complaint heard by the Recreation Disputes CommiWee in The Hague or submit the complaint to the court competent by law. The decision of this commiWee will have the effect of a binding advice.
20. APPLICABLE LAW
20.1 The agreement between you and Qurios Holiday Retreats is governed exclusively by Dutch law.
21. TRAVEL DOCUMENTS
21.1 You are yourself responsible for possessing the valid travel documents required for your destination. Qurios Holiday Retreats accepts no liability for the consequences of not possessing the correct travel documents.
22.1 All data you provide to us is stored in a file. This file is registered with the Dutch Data Protec.on Authority in The Hague. The data file is used for our guest administration. These data may also be used to provide targeted informa.on and offers on our and related products and services, by both ourselves and by third par.es. In order to match this informa.on and these advantage offers with your interests as much as possible, we may have your data combined with data known to other companies.
22.2 At your request, we will improve, supplement, remove or protect your data, if the data are, for example, factually incorrect. This may mean that you can no longer make use of (some of) our services. You have the right to request that we notify you whether the personal data that pertain to you are processed.
22.3 If you would rather not receive interesting information or offers, please let us know by sending a card to: Qurios Holiday Retreats B.V., Olympisch Stadion 24-28, 1076 DE Amsterdam or an e-mail to info@Qurios.nl.
23.1 Qurios will send its correspondence digitally, unless this proves impossible.
23.2 Qurios Holiday Retreats B.V. is not bound by obvious misprints and typeselng errors.
